Legal Question in Wills and Trusts in California
Probate not closed after 3 years
I am the executor of my mother's estate. She died 8/2002. My father contested the probate. My attorney finally settled with my father in 6/2004. Orange county courts do not like the accounting. There have been 2-3 continuances to close this probate My attorney keeps not showing up. I have not been able to contact him. The judge has issued a bench warrant on my attorney with $6K bail. It will be enforced if he does not show up to the scheduled 12/22 hearing. I have no more money of my moms estate. I have paid whatever the cap is in Calif. to my attorney. What can I do? What should I do? If there are any attorneys out there willing to take this, what is an estimate to close this out -- I'm not sure what has been filed as far as the accounting... Please help.

Re: Probate not closed after 3 years
my firm can handle the accounting. it may cost anywhere from $1,000 to $2,000 depending on what needs to be done. it's always more difficult to do an accounting, when another attorney handled to administrative functions because it's more difficult to retrace another's steps. hopefully everything is in the file, and it can be obtained. if you're interested give me a call.
Sincerely,
Phillip C. Lemmons, Esq.
