Legal Question in Wills and Trusts in California

Probate

When the executor of my father's will (my older brother) sends me a email that says. That he got a new attorney and the attny looked over the paperwork and was going to put it through as a SIMPLE SET ASIDE. What does that mean simple set aside?

Re: Probate

In our office when we refer to a "set aside" we usually mean a Spousal Property Petition which is typically used to transfer property between a husband a and wife after death. Can be for many reasons but is most typically used when they held property as "community property" rather than "joint tenants." It may also refer to one of the other "mini" probate procedures like real property worth less than $100,000? Just guessing. Good luck.
