Legal Question in Wills and Trusts in California
Probate
I just found out that my Mother died 3 years ago and no one bothered to tell me. My sister and I owned her home in California and during my divorce 10 years ago, I signed my share over to my Mother to protect her home. My sister, Mother and I became estranged at this point. Since it's been 3 years and the house has been sold and the profits kept by my sister, is there any recourse for me? I'm just devistated!

Re: Probate
Well.... This depends on a number of factors: 1st, whether you gifted your share over to your mother completely or you retained something like a life estate; 2nd whether your Mother wrote a trust or will that specifically did not leave the home to you; 3rd whether such a will/trust was valid and whether you might be entitled to part of the inheritance.
Because there are so many variables, I would contact an attorney to review your specific situation.
