Legal Question in Wills and Trusts in California
probate law
my half sister is taking me to court for accouting of my fathers trust. My twin sister was the executor and has since spent all money in the trust without distrubuting it accordingly. I have no records on the acounting. she could no longer afford the family home so I sold mine, and moved into it to take care of it and fix damages. her and my half sister now want it sold and want me striken from the trust. I have done nothing wrong or against the trust infact have tried to fix up the house that my twin sister destroyed. what am I responsible to provide to the court other then from when I took over the house in nov.06 till now.

Re: probate law
Get an attorney to represent you. Liability of a fiduciary, i.e. trustee, is potentially devastating, since that liability cannot be even discharged in bankruptcy. If you haven't done anything wrong the cost of your defense of the lawsuit should come out of the trust estate.
