You do not NEED one, but one is certainly recommended, the Court will probably tell you the same, especially if there are any items in controversy.

It's easier to hire a lawyer, but if you want to try to do it yourself, consult a good book for the layperson... I recommend Nolo Press "How to Probate and Estate" which has sample forms as well as instructions.
Re: probate matter
If reading through a book such as Nolo's still makles you uncomfortable as to filing the probate, go down to the probate court and look through some files to see the paperwork in them. Remember court's often have their own local rules and sometimes forms.
