probate

if your mother wrote her will and gave property that she knew she would be inheiriting from her older brother but had not yet recieved the paper work. Is it legal. to write a will based on a discussion

You can put anything you want into a Will. Only proprety covered by the Will at the time of death is effected by the Will. So your mother can put the property into her Will as what she is saying is that if at the time of her death she owns that property and it is part of her assets covered by the Will, then she gives her interests in the property to whomever she has named as benificiary in the Will.

Yes. But if she doesn't own it at the time of her death, it will be meaningless.
