probate problems
my dad's probate case is now in the 20th month. I am having problems with the executor my sister and her lawyer.I previously had a lawyer here in so.calif.whom the executor and her lawyer completely ignored so I got rid of him. I contacted another lawyer up north where the case is being done on monday. He was supposed to c/b wednesday but to date I have not received a reply. I have papers showing the deceit of my sister and her lawyer and a questionable 706 form that the court should see. Can a beneficiary mail copies of these letters to the probate court? Or do I need to have a lawyer up north submit the papers on behalf of me? Thanks for the advise.

While you can file papers through the mail, if they are not done properly they will not accomplish anything for you. Furthermore, a petition of some kind could result in the need for a hearing, which would require your attendance.

You should have a lawyer to protect your interest. You need to determine what stage of the probate process the case is in, and what can be done at this point. The court is their to protect the interests of creditors and beneficiaries. Please call if you would like us to help.
