How long does a claim have to be filed against an estate in probate?

Once an estate is opened, four months notice to creditors in the newspaper is the law in Tennessee. If no claim against tht estate is filed during the four month time span, the claim is normally barred. Medicaid (known as Tenncare in Tennessee) has one year from the date of death to file a claim against an estate in Tennessee or else the claim is barred.

4 months from date letters were issued to the administrator or 2 months from date of notice of administration was served on the creditor, if it was given pursuant to probate code secion 9051.
