Legal Question in Wills and Trusts in California

Probate after 8 yrs?

My grandma passed away 8 years ago. No one has ever done probate. no one in my family speaks to each other at all. I want to do probate, but have no money. (my spouse is not working)It would be a shame for the state to take her house/ land when I know it is not what she would want. (very old and unlivable not worth a lot) The house has been vandalized and sitting empty. If my mom signs off on me to take care of the probate, can the expenses and appraisals be taken form the estate? Can I get probate going after so many yrs and with no money?

Re: Probate after 8 yrs?

It will depend upon a number of factors from the size of the estate, etc.

Attorney's fees and the administrator's fees are typically payable at a fixed rate based upon statute (law) and paid by the estate.

The probate is typically going to be in the county in which she resided upon her death.
