Legal Question in Wills and Trusts in California

Probate-vehicle with lien

My mother's estate in probate; no will. She has a vehicle that she still owes quite a lot of money on. The car is in excellent condition and I want to return the vehicle, however I am concerned that the estate will still be hit hard financially with the payout. Is it possible to negotiate with finance co. even when the estate being in probate?

Re: Probate-vehicle with lien

You can always try to negotiate with anyone at any time; the issue is whether they are likely to d something. They may be, because no one has to take a gift stated to be for them. So you could argue that no one wants to take the car at that price and the assets of the estate are limited, so they should compromise.
