Legal Question in Wills and Trusts in California

Probating of wills

When a will is opened for probate, what is the procedure for notifying those named in the will,be they beneficiaries or not? Must they receive a copy of the will? Does the will become public after probate?

Where can I find the statutory executor fee schedule?

Re: Probating of wills

When the probate is filed you give them notice on a notice of hearing form you can get from the court clerk. They are entitled to a copy of the will and the will is filed with the court and is public record. The fee schedule is in the probate code. I dont know the section off hand (perhaps someone else can help me here) but you can find it at http://www.leginfo.ca.gov/calaw.html
