property under $100,000
My father passed away and did not have a will. He has a piece of property in California that was 10,000 when he purchased it. I am his next of kin (daughter). Where do I go from here will it have to go through probate or can I fill out the proper paperwork after the 40th day of his death?

Where are you located?
The short answer is that land in California will need to go through probate.

It sounds like you are talking about real estate. If the date of death is under $100,000 then a Probate Code 13150 petition would be the right thing most likely. If you would like to hire a certified specialist in probate law please call me to discuss your case! -John
