Getting property titled in our names after death
My Aunt died in May 2002 leaving my Grandmother's property to me, my 2 siblings, and her step-grandaughter. My aunt had a special needs trust to care for her ailing husband, who died in early Nov 2002. What we want to know is how long does it take to get the property in our names?? We've had no conversation with trustee since my uncle's death. She has been very uncooperative with us since my aunt's death. Another situation we are dealing with--the trustee is the mom of the step-grandaughter who inhertied 1/4 of our property. What kind of time frame can we reasonably assume in this situation?? We're just wondering if we're expecting things to happen too soon.

It may be too soon, but you should be receiving notice from the trustee by the end of January. You are also entitled to a copy of the trust, and information regarding the administration of the trust including assets, liabilities and actions of the trustee. If you don't hear anything soon, get no cooperation from the trustee or have reasonable suspicion the trustee is breaching a duty, you may wish to see an attorney.
