Legal Question in Wills and Trusts in California
Did Not Receive Monies from Family Trust as Described
I was made a beneficiary in my family's trust where I was to receive 1/2 at the age of 21 and the remaing 1/2 at the age of thirty. I am 27 now and have not received what was described in the trust.
I have requested accounting from the trustee only to be told that the trust is closed, the funds have been dispersed and the accounting has been destroyed. I have all documents pertaining the the will and trust as well as coorspondance with the trustee regarding this.
I need assistance in getting what I was supossed to receive and I have no clue where to begin. Any assistance would be much appreciated!

Sounds like the trustee needs to be asked some hard questions. If he or she will not respond, the next step would be to file a lawsuit to compel an accounting and possibly seek to surcharge the trustee. Our firm has lots of experience with these issues and we would be happy to evaluate your case at no charge. Please contact our office for an appointment.

Since you have already requested information and been stonewalled, I think it's time for you to get an attorney to start firing stuff out on your behalf.
This situation can go in one of two directions. Either there were insufficient assets in the trust to have anything to distribute to you. Or, start the ball rolling in filing a lawsuit against the trustee.
I would be happy to discuss this matter with you.

You need an attorney to demand an accounting. If the trustee does not comply, your attorney will have to file a lawsuit demaning an accounting and possibly surcharging the trustee.
Please e-mail me with contact information or call me for a free telephone and/or office consultation to evaulate your case.
Good luck and thank you for your inquiry.
