With a local attorney, an out of state attorney can apply for PRO HAC VICE, to represent someone for one case, without taking the bar exam.

It would largely depend on the attorney's capacity. If the attorney of record is a California attorney, and the out of state attorney is not actually practicing law, there may be no issues when hiring an out of state attorney. However, your best bet (legally and morally) may be to hire California attorneys, so that your firm can continue to be an integral part of the California economy.
