Legal Question in Wills and Trusts in California

Relocation, Sanity of benefeciaries and witness:

I have been researching to find out if the beneficiaries have to remain sane in

order recieve their inheritance? And what happens if one or both of the

witnesses have alzheimers, have aged or any likeness that leaves their sanity

questionable? Will that make your last will and testament invalid in a court of

law? What if you move to another state? Will a new last will and testament

need to be drawn?

Thank you.

Re: Relocation, Sanity of benefeciaries and witness:

Beneficiaries receive their inheritance whether sane or not--that inheritance may end up going to a trustee or conservator to hold for them, but it's theirs nonetheless.

The will would be valid in other states, but it still pays to have it reviewed to make sure the new state's law doesn't create a different result than what the will would have done in the original state.
