Legal Question in Wills and Trusts in California
we are the respondents to a petition before the San Luis Obispo Probate Court. We have just filed an opposition paper with the court clerk and now need to serve it on the opposing parties. my questions are:
o do all four petitioners and their counsel need to be served with the opposition we filed, or just their attorney?
o my sister andI I are both parties to the matter and in pro per (not by choice). Can we serve the opposing party and/or counsl, or do we need to hire a service?
The hearing is on calendar for tomorrow morning at 9AM, so I guess you could say time is of the essence and a speedy response will be GREATLY appreceiated!
Thank you in advance for any help you can offer.
1 Answer from Attorneys
Someone who is over the age of 18 and not a party to the proceeding needs to serve the papers. If a party is represented by counsel, the attorney is served, unless a statute or rule provides otherwise.
