Legal Question in Wills and Trusts in California

Can I restructure my annuity payments I recieve monthly from a insurance company? I get $48,000.00 divided in monthly payments till 2014 but I need a lump sum of $5,000.00.

Annuity Loan companies charge a arm and a leg to loan on my annuity and they have to go through the courts first.

Can I do it myself through the courts to restructure and get the $5,000.00?
