Legal Question in Wills and Trusts in California

My rights as the person living in the house, wanting to sell even though brother

I want to sell the house that was left to me, my brother and sister. All of our names is on the

deed to the house. I have been the only one paying all the insurance and taxes on the house.

My sister tells me that she is gonna change the locks on the house, her and my brother comes

to my house everyday and when I tell them to leave they say ''This is my house I don't have

to go anywhere. My sister is always threatening me saying she is getting the house it's just a

matter of time. She doesn't want to sell it, I do. She can't afford to buy me out because she

does not have a job. Her nor my brother has helped me pay for any taxes, insurance or repairs

since my mother passed away. What are my rights? Can my sister just come in at any time she wants to and start living with me without my knowledge? Are we able to go to court and just

let the judge decide to sell it or not. Thank you from a Stressed man

Re: My rights as the person living in the house, wanting to sell even though bro

You could sell your 1/3 at any time, but who will buy 1/3 of a house? You can file a court action to force the sale of the property, and you may be entitled to reimbursement for the taxes and insurance from the total proceeds.
