What to do as Single parent with death of single adult child without will.,

My only son was killed in motorcyle-car accident April 9th. Not his fault. No Will or anything. Have no idea what Legal forms may be required to close his affairs, like Credit Cards, Car [his name only-no loan-paid for] cancel Insurance, loan for Motorcycle. Cancel his cell phone, etc. He did his taxes, check has not arrived, what do I do with it. I have never been responsible for personal affairs in the case of death. I was disabled five years ago, son lived at home, but spent evenings/nights at girlfriends. He was in Army Reserves but never sent into action. Honerable Disch. 2002. Woked at Post Office, Casual not Full Time. I am 55, son was 31. Aside from feeling shattered to lose my only child, I am clueless what to do next and what legal forms I may need to take care of his personnal business correctly.

Sorry for your loss.

You will need at least a dozen death certificates. Maybe the funeral home can help you arrange for these.

For credit cards, you can send them a death certificate and inform them you lost your son. You should not pay any balance.

For many of these other issues, including insurance related issues, you probably should hire an attorney to help you work through the paper work. You might also explore whether a wrongful death action exists.

I am very sorry you lost your son. Aside from the wise words of attorney Muntean, remember that you yourself, as his mother, have the right to hold the driver of the other car accountable by filing a lawsuit for wrongful death. While in some cases you could have up to two years to sue, it's important to retain an attorney right away so the evidence can be preserved and so that all your legal rights can be protected.

You should talk to an attorney regarding a possible wrongful death action and possible insurance claims.

If you son has assets and funds they must be used to paid his debts.
