Legal Question in Wills and Trusts in California

My sister was named executor of my Mom's estate. All children are named beneficiaries to receive an equal share once all assets are liquidated. My question is this. Currently the executor's son is living in my Mom's house renting it, the property has fell into disrepair and he is also in arrears with rent by $17,000, does this situation constitute a conflict of interest with the executor?
