Legal Question in Wills and Trusts in California
My sister retained a lawyer without consulting with any of her siblings that were also named on a will ,the will has complication as this property was owned by two sisters ..one sister had no will she passed away 30 years ago and the other sister had a will,my sisters attorney said she would have to trace all living relatives of the first sister she had no children never married ,second sister had a will ,so the house cannot be sold until all reletives are located,so in the meantime the debt is piling up ,rent, personel debt and attorney fees. Now my sister that retained an attorney said she doesn't want anything to do with the property .my question who pays for the attorney that my sister retained ..
1 Answer from Attorneys
Your sister pays her own attorney, as she had what is called beneficiary representation.
