Legal Question in Wills and Trusts in California
A Very Slow Executor
My grandmother passed away in December 2007. My uncle is the executor of the will. He has not made any effort to sell the home and using the remaining bank account to pay the morgage. As property values drop we are concerned with the limited efforts. The executor has also expressed that he would like to buy out my father. Another reason for the concern over the falling property values as time goes by. Does the executor have any time frame in which he must have the property appraised and or sold?

Re: A Very Slow Executor
As an interested party you can petition the court to require the property be sold now, etc. An executor is subject to court supervision. You can even petition to replace the executor. The other heirs and beneficiaries should hire a lawyer to represent your interests.
