Legal Question in Wills and Trusts in California
Special Needs Trust Help
Hello I broke my neck and was paralyzed. I won some money in a lawsuit. The court decided to split the money. This was 10 years ago. I have spent the first half and would like the rest. What is the next step? Thank you

Re: Special Needs Trust Help
I am sorry to hear of your injuries and I hope I can help.
The terms of the Court's prior Ruling will determine your answer. Look to the type of split? Was it placed in a trust fund? Why? Were you a minor at the time of the incident?
You have rights and you need to know what they are. If you have a copy of the Judgment, I would be happy to take a look and let you know what I find.

Re: Special Needs Trust Help
Where is your attorney. If this was a structured settlement what does this settlement agreement say. If this was a verdict by a jury why is it structured. What he'd do next. Get older your original attorney or get a new attorney immediately to review the settlement agreement and/or the verdict. Don't wait, it's your money.I have been practicing law in this legal area for over 30 years and understand your problem well. I practice in the S.F. If there's a special needs trust, an attorney will need to review the trust terms to see how to get distributions. The settlement agreement would also need to be reviewed, and then an attorney can advise you regarding how to get the distributions.
