Legal Question in Wills and Trusts in California
Where do I stand
My sister and I are heirs to my fathers estate equally. Since my fathers death she is claiming to recieve 10,000 dollars of my share. Due to lost wages and compensation of her time along with living expenses since my father was living with her the last year of his life. Nothing is in writing in the will of this.
Where do I stand. Can she claim some of my inheritance if she has kept recorded reciepts and ect.....

She may be able to ask for a statutory fee for administering your father's estate.
Has his will be admitted to probate? If so, the court needs to approve her request for fees other than statutory fees in this matter. The purpose of statutory fees to renumerate your sister for the duties in handling his probate estate.
If this is not what your sister is referring to, it may not be proper for her to ask for payment for services rendered or time spent while your father was alive.
Again, it depends what's going on here -- is the will in probate? Or did your Dad have a trust? Without additional facts, your sister likely can't just pay herself as you describe, but again more information is needed.
