There are different options depending on value. If under $100,000 in gross value then an expedited petition may be done to transfer title. That takes about 6-8 weeks. If the gross value is more than $100,000 then a full probate would be required. While an attorney is not required for probate it will make it much easier and generally save you money in the long run by getting everything done efficiently and correctly. By the way you ask the question I assume you are the sole heirs, and that your names are not already on title.
