Legal Question in Wills and Trusts in California

State gets money from sale of Mobile home

If a person dies and is covered by Medi-cal, even as secondary coverage, why does the state of CA get the proceeds from the sale of their Mobile Home? I've had one aunt that this happened to and another that was fortunate enough to transfer it out of her name prior to the sale, and the money was given back to her to pay for her funeral. I've just lost my mom and she had a mobile home and had Medi-cal as secondary coverage so I'm unsure if I can legally sell it, I'm the only benificiary in her will, or will the state come after me for the money?

Medi-Cal is more like a loan than a gift, unless you have no assets. You need to notify Medi-Cal that your mother passed away. If they are owed money, they will let you know. If ot you can go ahead and sell. You may also be able to negotiate a lower amount.
