Legal Question in Wills and Trusts in California

Step Children Exempt Form Inheirtance

My father passed away last summer and left a will which lists all his children who are his beneficiaries. Is it true that California law states that step children are exempt from any monies or assests unless otherwise stated?

I am sorry to hear about your father's passing. These kinds of situations don't make things any easier. Unfortunately, I have to give the classic lawyer line "It depends." If the will clearly intended to not include step children, then they likely take nothing. If it is unclear, there is case law that permits step children to be included if there children are treated as a group. Find compentent counsel in the county where the will is to be probated. If you are in Marin or Sonoma counties, I would be happy to assist you.
