Legal Question in Wills and Trusts in California

What steps are needed in order to resolve these situations under these circumstances: Father passed away and I am his eldest son. He has a trailer home and I would like to know how much it's worth and what probate means, if it

is even applicable under these circumstances? Next, we need to

know if we can get backpay space rent if the trailer park decides they want to buy back the house? Then, what happens with all of my dads creditors? We need to find a place to bury his cremated remains, pay the rent owed on the trailer up to present day and I need to pay back my grandfather for loaning me money for the cremation process at the mortuary? I also have found retirement fund papers that I would like to know how that gets taken care of also. If you could let me know the answers to these and what steps need to be done, I would greatly appreciate that!

You need to see a probate attorney near to where you live . If the trailer is a marketable mobilehome then it does have value and you will need to be appointed administrator of your fathers estate in order to sell it. If it is worth less than 100, 000. you can use the small estate affidavit procedure . The retirement fund managers will need to see a court order authorizing you to act before they start disbursing any funds unless your dad named you or someone else as beneficiary.
