substitution of atty

I am the guardian ad litem in a matter that has settled..the atty has titled himself as trustee of the minors money..havent reced statments dont know where the funds are, etc. want to fire..what if he doesnt sign the sub of atty form?

Re: substitution of atty

He has to sign the substitution of attorney form, but if he's trustee, it may take a court order to remove him as trustee. This is a separate matter from being the attorney. You can ask him to resign, and also demand the trust information under Probate Code Section 16061. If he doesn't comply, it may be worth bringing a petition to have a new trustee appointed.
