Legal Question in Wills and Trusts in California

Can I sue for pictures with sentimental value. This past August my ex-husband passed away from a heat attack. My children are 9 and 11 and were with him when he passed. His older children who are 16 and 19 had no relationship with thier father for the past 5 years+. Before the funeral we all had to get together to plan for the funeral, etc. We decided to do a sort of bulliten board of pictures at his funeral. Pictures of his life from childhood-through death. I allowed my ex-step-daughter to borrow about 100 or so photos for the board as she was in charge or doing the bulliton board and I was in charge of finding a pastor to do the service. The funeral was in August and I have asked for the return of the pictures at least 5 times since then. I keep getting the run around. It is really bothering me because that is all my children have left of thier father--the older kids got all his assets as the oldest was 19 and the next of kin...But the pictures were mine and in my opinion belong to my children. Can I sue? Or can I threaten to sue for 1/2 the money from assets if the pictures are not returned. We do not want any $ from his assets as it is just been to stressful to deal with---but how do I go about getting the pictures back?

Sorry for your loss, and added frustration. Yes, those pictures are your property and you have a right to them. You can sue for them if necessary, but I think a polite but motivating letter from an attorney would help get them back. Please contact my office and we can get it out immediately.
