Legal Question in Wills and Trusts in California

Someone suggested that I submit a form for homesteading my home. They said that by doing this it will bring to the surface just who is the owner and so-on. I am a life estate resident and their is much confusion about the way the deed should read and just whom the real owner is. To say that the remainderman wants me out of the picture is putting it mildly. This gift came from a trust estate.

Recording a Declaration of Homestead will not establish your rights to the property. I urge you to consult with a trusts and estates attorney immediately. At the very least, the attorney will want to examine a copy of the trust, and certainly the current deed to the property. There might be other documents in the public record that are relevant, as well. This is NOT a do-it-yourself project! Best of luck.
