Legal Question in Wills and Trusts in California
where can i get suggestions for various financial documents i should request from my step brother to determine the exact value and assets of her estate? He lied and said she didn't have Will, he refused to send us the trust until after my step father died which happened 8 months later. We were refused the name of the nursing home my step father was in. We were not told of my step father's death until 4 months after he died, and this was only because we called mystep brother. We asked for an accounting and several months passed before we got a partial accounting--only included information from after the death of my step father, thus, not including assets that he spent and/or collected between my mother and step father's deaths. It has now been almost 4 years since my mother passed and over 3 years since my step father passed. We were told by our mother that she had a trust and a will and that she also had life insurance policies for both her and my step father. My step brother and his wife have had complete control over their home, their documents and all of their personal possessions. What kind of documents can we ask that he turn over in our case and or subpoena?
1 Answer from Attorneys
Do you really think that a simple request of your step brother from documents in going to get you any real information at this point more than three years after receiving nothing. You need to consult with an attorney and use the legal system to obtain the information and accounting needed. Asking questions on the internet is a waste of time.
