how do you go about suing the executor of a trust in california who has not performed their duties

You would file a petition in the Probate Court of the County in which the trust is being administered. The form of the petition and the Probate Code sections that it would be mae under will depend on exactly what the trustee has or has not done and what you are seeking to accomplish.
