Legal Question in Wills and Trusts in California

time to contest a will

How long do you have to contest a will? Can I place the property of my stepmother if the will left everything to his wife not stating the name of wife? If yes how do I do that? Please let me know. Thank You--name removed--Devia

I don't quite understand the question. Has a probate been started? If so, that is where a will is contested. You need some professional help to handle this matter.

Generally, you have to challenge the will within 4 months after it has been admitted to probate. Usually, the latest you can challenge it is one year after it was admitted to probate, unless you were entitled to notice and didn't receive it because of fraud. You should consult an attorney as soon as possible.
