Timeline for trust deed to change hands
How long does a trustee legally have to sign over a trust deed? My aunt died on May 3, 2002 and we have not yet gotten the deed for our property. The trustee is not a beneficiary and we believe she is dragging her feet in order for the trust to pay more of her lawyer fees. We have been given the impression that she can wait until the 1 year date of my aunt's death? Is this true?

from the facts given, it sounds like the trustee is not acting in a reasonable manner in delivery the trust deed res over to you as a beneficiary if the trust instrument itself clearly states she is to do that. thus, she may be breaching her fiduciary duties of due care and/or loyalty. if you have a copy of the trust instrument or can give me all the provisions regarding this transfer of title, i can better further assist you in this matter and possibly get the court to make her transfer title to you without any further delay. email me today with more information if you will.
