Obtain the service of a probate lawyer who has experience in guardianships and conservatorship proceedings; these types of proceedings are very difficult to implement and oppose which require a qualified lawyer.

Much depends on the status of the petition for guardianship.

If the petition has not already been granted, you can simply oppose the petition -- no motion is required. If the petition has been granted, you will need to file your own petition for dissolution.

You have little chance of success without the aid of a lawyer who knows how to handle these proceedings. A lawyer can also tell you if you have a solid basis for the challenge, and whether it is worth the time and money to proceed.
