Legal Question in Wills and Trusts in California

Transfer of property by illiterate person

In 1988 my mother passed away without a will, my father then made a will leaving his estate to his 5 children.Basically he only had a house. He passed away this fall and we found out that one child who handled his affairs, has had their name put on the deed, for all we knew my mothers name was still on it. He could not read or write and did not tell anyone of this. A different attorney other than his, did this. Is there anything the surviving 4 children can do.

Re: Transfer of property by illiterate person

the information that you have provided is somewhat vague. Where did the mother and father live at the time of death, Tenn. or Calif.

Was there a will, or did one or both of them die without a will. I can only give advice as to California law, but would be willing to answer more direct questions if they and the property were in Calif.
