Legal Question in Wills and Trusts in California

trust

My stepmother has tried to remove my brother and I from a trust and will where we split 50% of my father's modest estate, (he has Alzheimer's), and being unsuccessful, but trustee, is sending money in the form of checks overseas to her family to raid the trust so in essence there will be nothing left. What are our options?

It depends on the terms of the trust, that is, if she has the right to invade the corpus (the funding) of your father's portion.

You may want to retain counsel to compel an accounting of the trust. That way, there is no contest to the trust (in case there is a 'no-contest clause') but you can find out what is being doe with the money.
