Legal Question in Wills and Trusts in California

Trust or Will Time Limit

My father committed suicide, 1 year and two weeks ago, His very young wife of two years, said he had his will changed leaving everything to her. Four months before he died. She has never allowed any of us four children of his to see it. Is it to late for us to look at it? And how do we go about it?

Re: Trust or Will Time Limit

You can file a probate your self on behalf of your father's estate. If he really did sign a new will, the probate will force the wife to file will with the court and prove it to be authentic. If you're in the Southern California area and need assistance with this, please feel free to give me a call.

I agree with Mr. Koury. In addition, the rules state that the will must be filed with the court within 30 days of death. You may want to check with your local court to see if the will is on file. If you are in Northern California and need help, please let me know.
