Legal Question in Wills and Trusts in California
trust and wills
i have a hand written will also known as a holographic, that is dated and signed by my grandmother. in her will my name is there along with her other children, and the policy number of our insurance. my mom had a lawyer who handle her living trust but my brother was her personal representative. he was suppose to make sure her wishes were carried out. i would like to know if he can get in trouble for not honering her wishes? and does this remove him from the will? also what is the law or penol code when you violate something like this? do people like this get away with abusing their power? my mother left behind two houses and two life insurance, including her burrial insurance which today my mother still does not have a head stone. please provide me with enough information so i can make him pay for what he has done. also i have a meeting with my mother lawyer next week. i thought that your lawyer is also suppose to make sure things go right afther someone death.

Re: trust and wills
if you believe that you were to benefit from your grandmother's will and your mothers' trust, you should retain a qualified attorney to review the documents and facts and advise you regarding your rights and possible actions against your brother.
