Legal Question in Wills and Trusts in California

Hello,

I am the trustee on my uncle's revokable trust. He created the trust when he was living in Illinois and now lives in California. He wants to amend one section concerning the dispersment of his assets. Can his trust be amended in California although it was originated in Illinois?

Yes. However, he should have an attorney licensed in California prepare the amendment and review the terms of the trust to make sure they are appropriate under California law.

Your uncle can amend his trust. I would recommend that any amendment should include any necessary provisions that will conform his trust to Califoria law.
