Legal Question in Wills and Trusts in California

My uncle is the trustee of my deceased mother's trust. 60 days ago I sent him a letter by certified mail, with return receipt, requesting a copy of the trust. Two weeks ago he said he would send it, along with the accounting, but I've received nothing. I think my next step is to petition the court. Can I do that myself or do I need a lawyer? I've no income, so how can I make sure my uncle will have to pay any court/lawyer fees? Should I send him another letter?

He also sent me a personal check as a "trust disbursal", but I'm afraid to cash it before I see the trust.

You can petition the court for a copy of the terms of the trust and an accounting, under most circumstances. You may also be entitled to a Fee Waiver (California Judicial Council From FW-001) http://www.courtinfo.ca.gov/forms/documents/fw001.pdf
