Legal Question in Wills and Trusts in California

My unmarried brother died suddenly, his real estate owe more than its worth and no will. Only asset left was a car and some money in the bank what should I do. Can I just obtain a right to the car only and a little money left in the bank (around $1000.00).

If the bank forecloses on the house, the house would no longer be in your brother's estate, and you can do a small estate affidavit for both the car and the bank account because there will be no probate.
