Legal Question in Wills and Trusts in California

Unmarried Parent Left No Will

I am 21 years old and live in California. Sadly, my biological father passed away. He left no will. Verbally he made it clear that all his possessions were to go to me (house, trust fund, ect). He was unmarried and had no other children. Am I entitled to his possessions? What if his brother owned half of his house? What about his trust fund, stocks, ect.?

Re: Unmarried Parent Left No Will

Under California law so long as you were recognized during his lifetime to be his son, you should inherit all of his* property.

*you will only inherit that property which he held an interest, and inherit no more than the interest he held.

You are welcome to give my office a call, in this type proceeding you really should have a representative.

Re: Unmarried Parent Left No Will

I am sorry to hear of your father passing away.

Without a will, all of your father's property goes by the laws of intestate succession according to the laws of California.

According to your facts, all of his property would go to you. His brother would receive nothing, unless he was designated as a beneficiary.

I have over 26 years experience in probate administration. If you would like a free consultation, please e-mail me with contact information or telephone me.

Good luck and thank your for your inquiry.
