Legal Question in Wills and Trusts in California

validity of ca living trust

My sister drafted a living trust with a do-it-yourself kit online in my 87 year old mother's name and had my mother sign it in front of a notary. This sister is named as both a successor, co-trustee and a beneficuary. Is this trust valid?

This is all too common. There is not enough information to determine the trust's validity. Whether or not it's valid, it is certainly voidable. There are other issues here, however. You may want to have your mother conserved before your sister ends up with all her assets.
