Legal Question in Wills and Trusts in California

Waiver of Interest on Real Property for Cash

I have been asked to waive my interests to the real property included in my grandmother's estate for cash. She held the property in common with one of my cousins and that cousin would like the entire property. When I questioned the attorney he said the additional money would come out of the estate. Would that mean that the other beneficiaries would receive less since they waived their interests without cash compensation? I don't understand how she would not be responsible for reimbursing the estate for this additional amount. I can't get a straight answer from anyone.

Re: Waiver of Interest on Real Property for Cash

I agree that the attorney's statement doesn't make sense, unless the cousin is first paying the estate for the joint interest and that sum will be in turn paid to you. Keep asking the hard questions and ask for a better explanation. If you can't get one, feel free to contact our office and we would be happy to assist you with the matter.
