Legal Question in Wills and Trusts in California
My wife has received court approval to be administrator of her mother's estate subject to securing a bond in the amount of $60k. One of eleven beneficiaries is objecting to probate as he does not want the real estate sold as he is living there rent free. Due to his objection she has not been able to qualify for the bond. Need suggestions on how to proceed. Thank you, Fred.

Try another bonding company. Provide other security for the bond.
Agreed. It makes no sense she cannot be bonded because an heir is putting up a fight.

If you cannot find a bonding company, I suggest you purchase an hour of a probate attorney's time for assistance. Something is missing, and it is likely impossible to find it without a review of documents. You do not need to retain counsel for the entire probate -- just seek a consultation. It may be that the estate can reimburse the fees.
