Legal Question in Wills and Trusts in California

Will & Estate

My father died 17 yrs ago. He had a will and it was probated. My sister and I were his heirs. My sister died 1998, left an adult son. I recently discovered unclaimed money left by my father thru the state controller bureau of unclaimed property. I applied for the money, discovered no final decree of distribution ever filed in fathers probate from letter received from controllers office. The letter said I needed Letter of Testamentary appointing me executor of estate, to go to a court clerk and get letter before they could finish processing and complete my claim. I went to superior court probate office and spoke to person there, they did not understand me or what I needed even after I showed them the letter I received and said they were not allowed to offer advice other than for me to seek advice from attorney. Can someone help me with this situation. Is this something I can do myself or do I need to involve an attorney to complete fathers probate?

Re: Will & Estate

You can finish your father's probate yourself but whether or not that's a good use of your time is a question only you can answer. The process will probably be easier (but more expensive) with professional help.
