No will
My ex-husband died suddenly at the age of 50. He is survived by his present wife, 5 year old adopted daughter and our two sons ages 24 and 18. He was about to get a $65,000 insurance settlement at the time of his death. Since he left no will, does the settlement automatically go to his wife or are his two sons in anyway entitled to any part of it and if so how do they go about making a claim against any of his estate.

More information is needed to determine exactly what the children would be entitled to but they would probably be entitled to something. If the present wife does not file a probate then you should see an attorney about representing the children and file in a probate on their behalf.
